Notice to Bidders




The Singing Hills, Unit 1 – Infrastructure Improvements project is located at the NW corner of US 281 & SH 46 in Bulverde, Texas, Comal County. Singing Hills, Unit 1 encompasses a mixed-use development consisting of approximately 120 acres and provides the phased construction for all infrastructure, roadways, and Wastewater Treatment Plant in support of a mixed-use of Commercial & Retail pad sites, 2 large Anchor sites, Office Park, and Multi-Family.


Address sealed proposals for the Singing Hills Infrastructure Development Request for Proposal (RFP) #2 as follows: Waste Water Treatment Plant, Lift Station, Utilities (Storm Drainage, Domestic Water Service, Sanitary Sewer, Recycle Water Service, Street MBC), Electrical & Communication, and Landscape & Irrigation to Middleman Construction Company LLC (Construction Manager at Risk) on behalf of SH-DJL Development, LLC c/o REOC Partners, Ltd. ("Owner"), on behalf of the Comal County Water Control and Improvement District No. 6 (the "District"), for the construction of "Singing Hills Development – RFP #2" in Comal County will be received at the jobsite office of Middleman Construction Company LLC at 4201 US 281 North (former EMS Building), Bulverde (address), Texas 78163 until 10:00a.m. CST on the date of May 1, 2013 at which time the proposals will be publicly opened and read aloud. Any proposals received after 10:00am CST will be returned unopened. Plans, specifications and contract documents may be obtained at the home office of Middleman Construction Company LLC at 9631 McCullough Avenue, San Antonio, TX 78216. Copies may be obtained for a non-refundable fee of $500.00. Checks for the plans and specifications should be made payable to Middleman Construction Company LLC.


A Cashier’s Check, Certified Check or Bid Bond payable to SH-DJL Development, LLC (the Owner) in an amount not less than five percent (5%) of the total bid must accompany the bid proposals as a guarantee that, if awarded the contract, the bidder will within ten (10) days of the award of the contract, enter into a contract and furnish an acceptable Performance and Payment Bond in the amount of one hundred percent (100%) of the contract price. The Bidder’s Check or Bid Bond will be forfeited and become the property of the Owner should the bidder fail to enter into a contract and furnish bonds acceptable to the Owner within ten (10) days after award of the contract.


No proposals shall be withdrawn for a period of sixty (60) days after the opening of the bids. The Owner reserves the right to reject any and/or all bids and to waive all formalities in the bidding process. The Owner also reserves the right to determine which bid is lowest and the best value, and to award the contract on this basis. It should be noted that time is of the essence on this project.


A Maintenance Bond to the benefit of the Comal County Water Control and Improvement District No. 6 (the District) will be required in the amount of ten percent (10%) of the contract price and is to remain in force for a period of one year from the date of the letter of final acceptance from the District.

A Mandatory RFP#2 Pre-Bid Conference among Construction Manager at Risk, Owner, Engineers, and prospective bidders will be held to discuss the Scope of Work and to answer questions concerning the work. The Mandatory Pre-Bid Conference will be held at the jobsite office shown above on April 18, 2013, at 2:00pm CST. Attendance by each prospective bidder or its representative is mandatory, and no bid will be opened unless the bidder or representative was present at the Pre-Bid Conference.

Qualification of Bidders:


All Bidders shall submit the Contractor Qualification Form to Middleman Construction Company along with their formal Bid; this information shall be considered in the award of the Contract. Failure to accurately complete the Contractor Qualification Form or failure to submit the Qualification Form with the Bid, will at the Owner’s option, disqualify the bidder from consideration in the award of the Contract.
